No, I'm not being disingenuous - I didn't e-mail Bob about it b/c I was deciding how to respond to it (well, racist spin on my nick aside, which he's still using). Hey there Ron - thanks for the invite. I may just have to move to CT or MA!!!! Very disappointed with the result of Prop 8 in Ca and too many mixed emotions. Looks like the churches, especially the Mormons and the Black community in Southern Cal really scared the ignorant populations into voting Yes - so, so maddening. Thank you to the Northern Cal folks that really tried to maintain our right to live as 1st class citizens - even the farm animals in California are now granted more rights than us. I'm depressed!

LAMBDA Legal Challenges Prop 8

Lambda Legal, The American Civil Liberties Union (ACLU) and the National Center for Lesbian Rights (NCLR) have urged the California Supreme Court to invalidate Proposition 8 if it passes.

The groups argue that Prop. 8 is invalid because it was improperly attempts to undo the constitution's core commitment to equality and deprives the courts of their essential role of protecting the rights of minorities. According to the California Constitution, such a radical change in the way the courts and state government work cannot be decided by a simple ballot measure. The legal groups filed the writ petition on behalf of Equality California and six same-sex couples.

Polly, What WAS Prop. 8 Exactly?

I gather if Lambda, the ACLU and NCLR are challenging it, it's not a California Constitutional Amendment but a law? Or is it something altogether different?

If it's a successful Constitutional Amendment (as horndog or coondog or bigdawg the "intellectual" conservative seems to think on the other thread, while nattering about "judicial activism" - you mean like the Supreme Court ruling GW Bush won in 2000?), I would assume that it could not be challenged in court on Constitutional grounds. I would also assume it would take a LOT more than just a popular vote to amend the CA Constitution.

I lived in San Diego for ten years through high school and college - you'd think I'd know this.... :/

Doc, it has been a long battle that really began years ago

Proposition 8 was a statewide initiative that claimed California must negate a previous Court decision stating same-sex marriage is a constitutionally-protected right in California. A majority of the justices of the states Supreme Court affirmed such in May this year. Since it has passed (which it did thanks to Mormon money and a huge majority of African American support), the state constitution will have a new addendum which states, "only marriage between a man and a woman is valid or recognized in California." It takes away basic civil rights already established for same sex couples (however it allows previous marriages to stand).

Well I'm no lawyer (so perhaps Essic can comment here) but as far as how the initiative can or can't be turned over, it is my understanding that the fight will be over whether the measure itself is constitutional. LAMDA Legal is currently taking it on and will be fighting it in the state Supreme Court. Here are some links that might shed more light on the subject.

Well, I'm not a lawyer, nor do I play one on or off TV, however I have "read" this has been done before. (Essic are you around?) Whether or not that holds up in court, well I suppose that depends on who is doing the holding. What I DO know is that there are some strong forces out there now who will challenge this prop and no matter who may say what, I DO believe that it stands a good chance of a reversal.

I got a disheartening-sounding "We will not give up" e-mail today from No on 8, so I was worried - and had no time to check on it further b/c I'm running around doing stuff the next several days that sort of got shoved aside for Election Fever.

I think Essic would probably say s/he is not licensed to practice in the State of California, and isn't up on how California ballot initiatives work since they work differently from state to state. (Not clear on Essic's gender, sorry - the English language desperately needs a gender-neutral pronoun less derogatory than "it".)

Maybe I'm taking this whole issue a bit too personally. Maybe I shouldn't take every single Yes on 8 sign as a personal affront, and maybe I should just get over being mad as hell that I've just been relegated to second-class citizenship by popular vote, and I should jump on the happy bandwagon.

Don't get me wrong -- I know that Obama's election is huge, and way more important for the country than what happened with prop 8. I'm happy and relieved, and I even teared up during his acceptance speech. But I and a lot of other people I know just aren't up to all the cheering and celebration.

And I was glad to hear the discussion, but I was wrong to be ticked off that she didn't talk about it the other day. I've always considered myself to be quite rational, and I'm surprised at how anger sent me so off kilter.

When Huffington Post ran a story on Rachel's interview with Obama, someone posted a comment calling her a sellout because she didn't ask Obama about his stance on gay marriage.

I promptly responded that it was absurd to call her a sellout because she didn't ask about that one issue. But then a few days later I find myself posting something that sort of followed the same absurd logic.

There is still a lot of anger in the gay community over prop 8. We need to figure out how to funnel these emotions into something positive.

Capn I was just kidding with you as I am well aware of your feelings toward the man and many of his policies, many of which I may even agree with. I preface that statement by saying "may" only because it depends on the day and how my stomach is holding up.

However, I am curious why you don't think Emanuel is a good choice for Chief of Staff. I don't particularly "like" the guy, but he most definitely IS a pit bull (without the lipstick) and I think that is a great attribute for this particular President elect. Obama can remain the cool and reasonable man you finally get to once you have gotten through the warrior some call Emanuel. It's the old "Good Cop, Bad Cop" type of thing and one that just might work to Obama's advantage.

So, why the hesitancy on Rahm?

Because...

...he's DLC, which to me means "Republican Lite". Which further means that as COS he's going to have a great deal of influence in who gets to see and talk to the President, ie, corporate lobbyists and other such scum.

Now maybe all Obama is doing here is some real politik, giving Emmnauel the spot to assuage the right-wing of the party--sadly, they remain a potent force, no matter what one might think of them. But I'd just as soon he found someone with a little less baggage. Like Toni Morrison, maybe.

I totally agree with you about Rahm's political affiliations, BUT this specific job is really more about him helping Obama day to day instead of dictating policy. Personally, I am not a fan of the DLC, blue Dog Dems or of the conservative D wing, but policy aside, I do think that Rahm's particular abilities make a good fit to Obama and may very well help, especially during the transition. He knows the people involved, he knows how to get things done and he is one heck of a heavy duty fighter as his nickname suggests (Rahm-bo).

Also, your point on Obama doing some politik-ing on this subject could very well be true and if that couples with a guy whose function fits well with what is needed in this crucial slot, than I say great...go to it Rahm.

You know, the issue of Obama's new hires brings to mind the question of just who he is planning to include in his new administration. This will be a fascinating ride, no?

I Have To Agree w/Cap'n, Emanuel is of the Clinton-LIEberman DLC

For my money, they should be given the back of Obama's hand for how they destroyed the progressive branch of Democratic Party for nearly two decades - and almost destroyed it for good. I lost all respect for any of them and their weaselly, "compromising" ways when President Bill Clinton signed, in short order, NAFTA, the Telecommunications Deregulations Act (w/the misnamed "Communications Decency Amendment" chaser!) and the Defense of Marriage Act. We're still fighting a mainly defensive war for individual liberties and equal rights for ALL people over a decade later - and losing as often as winning (ask the gay people of California!) - when an iota of genuine principle and testicular fortitude on the DLC's and especially the Clintons' part might have driven the hypocritical scumbags of the Khrister Right back into their hate-filled ratholes for the remaining life of our Republic.

I don't know how Obama will govern - but I believe he is a pragmatist, rather than an antiliberal ideologue like Rahm-Bo, Holy Joe the Quisling, James "I'm Sleeping w/the Enemy!" Carville, and Bill&Hil....

I know, I know, how simplistic, how idiotically droll and open to a kill, but nevertheless, I truly believe that Rahm Emanuel is a great manager, is one heck of a tough son of a gun, knows where the bodies are buried AND most importantly of all, IS a very good friend of Obama's. Now, not having ever have been a part of the White House or DC clique, I can't speak from experience, but I can speak to what I have heard about Rahm's abilities, connections AND his friendship to Barack.

From what I understand, to be a good Chief of Staff, you need someone with whom you can trust with your new born baby. It is (or should be) about someone with whom you believe will have your back no matter what may come up in that grand little district we call DC. This slot is about someone who can truly serve the Presidents best interests to heck with everyone else..

Now having said all of this, you need to understand that I have never been a fan of Rahm's personality, his politics or his hair (OK, so I'm a hair snob...)

I just heard her tell listeners on the radio show that there is a link to something that she and David Bender were talking about but this blog hasn't been changed since Wednesday am - just wondering?

Hello Ms Maddow:

I don't know if you are as happy as I am with our new President elect. However, yesterday (Wednesday) I remembered you asking your friend who gives you the amusing tidbits, just before you close. You were wondering why it was so quiet in the studio after the news of President elect Obama's victory.

I think I know why. After watching Mr. Chris Matthews during the election season, I thought he was for Mr Obama. However, his face fell after Mr. Olbermann broke the news that the President elect was Mr. Obama. There were others in the studio who came across as McCain supporters. Mr. Olbermann seemed to be the only one who was overjoyed at the news.

Tonight, you were not sure that hiring Mr. Emmanuel was the right move. I think we have studied Mr. Obama enough to know that he has a mind of his own. He listens to people and ultimately, makes up his own mind. I wouldn't fear Mr. Emmanuel influencing his decision, regarding Health Care. I don't see Mr. Obama as someone who can be influenced against his will, if he does not agree with the choice.

I think Mr. Emmanuel knows that the final decision will always rest with the President, whatever his (Mr. Emmanuel's) ulterior motives might be. I don't see him influencing Mr. Obama. He smiles easily and is soft spoken at times, but I see that steely side of him, just below the surface. He will quickly let people know where he stands, when it comes to issues near and dear to him.
This is just my opinion.

interview with Obama

First, I've not been around this page in well over a year. Secondly, I'm blown away by the makeup and fact that you interviewed Obama. Spot on. Thirdly, I'm deeply touched that he took the time to point out that your anger and interest in acting like there's a cadre of Republicans out there trying to ruin things for Democrats makes you look like you're itching for a fight. That part in the interview where he says he's doing something right? That part where he's patient and kind, and suggests that by not closing the door, and leaving the conversattion open to people who don't spend all day thinking like he thinks? That's the part of the conversation that matters.

After so many years. Fourteen years. Of thinking there was an enemy out there and it was the man, the sexist, classist, incapable of changing anything man--after fourteen years of thinking that---I took a step back and realized I was shutting myself off from a lot of the world by thinking I had all the answers. That's what made everyone all weepy in his acceptance speech--even if you don't agree with me, I'm on your side. We're all on the same side. The whole country. Peace, joy, friend, foe, black, white, gay, not-so-gay.

Sometimes listening to someone else's story is a whole lot more productive than trying to find someone to scapegoat . . . I'm so grateful he won. That's all I'm sayin. . .

Rachel on Colbert!!!!!!!

A triumph!
I normally can't stand Colbert's schtick...O'Reilly is annoying and Colbert lampooning O'Reilly is JUST as annoying. He gets great guests on and doesn't let them speak. Finally, he lets Rachel speak! I love that people can see that the high school principal who hosts TRMS TV show is young, hip, brilliant and REAL. Even Colbert knows that with a guest like Rachel, sometimes he needs to ease off on the schtick and let the guest shine!

It was awesome.

Personally, I love the Colbert Report. Plus, I've sometimes thought of Rachel as having some parallels to him:

They both used to do segments on the show before theirs, even occasionally hosting that show when the regular host was out.

They both graduated from that old show to having their own show.

They both do a "Toss" at the end of the preceding show that connects to their show.

They both have a name that can be pronounced two different ways. Pronouncing it the preferred way makes their name rhyme with the other word in the title of their show.

All little coincidences, but I get a kick out of them. Plus, I think there's a lot of overlap between the people who like the Colbert Report and the people who might like
